Is PAT Testing a Legal Requirement?

The short answer is no, not specifically. There's no legislation that names PAT testing as a legal requirement. What the law does require is that electrical equipment in use is maintained safely. PAT testing is the accepted method of demonstrating that, and the one most businesses, landlords, and insurers expect to see.


What the Law Actually Says

The Health and Safety at Work Act and the Electricity at Work Regulations place a clear duty on employers to maintain electrical equipment safely. They don't specify exactly how that should be demonstrated, but they do require that it is. For businesses, the Provision and Use of Work Equipment Regulations also requires equipment to be kept in efficient working order.

PAT testing has become the recognised standard because it's systematic, documented, and produces a clear record. If equipment causes an injury or a fire, the question you'll face is how you knew it was safe. A test record is a direct answer to that. Without it, the position is much harder to defend.

For landlords, the Housing Health and Safety Rating System requires electrical hazards to be managed. PAT testing isn't named in most residential legislation, but many local councils reference it in their guidance, and some include it as a condition in HMO licences.


Where It Becomes Effectively Mandatory

HMOs are the clearest example. Many HMO licences include a condition that portable appliances are regularly PAT tested. If yours does and you don't comply, you're in breach of your licence.

Insurance is the other area where it becomes non-negotiable in practice. Many commercial and landlord policies require evidence of regular electrical maintenance. If an electrical fault causes a claim and you can't show the equipment was tested, the insurer may refuse to pay out.


The Practical Reality

Most businesses and landlords that skip PAT testing do so because nobody has told them clearly where the line sits. The absence of a specific law can feel like permission to leave it. It isn't.

If something goes wrong, the question is always the same: how did you know it was safe? A PAT test record answers that question directly. Without one, you're relying on luck.

If you're not sure how often your appliances should be tested, annual testing is the right default for most businesses and rental properties. It satisfies most insurers, keeps your records current, and means you're never caught out.
